Premium Terms of Use

  1. Acceptance of the Premium Terms of Use 

These Premium Services Terms (“Premium Terms”) apply in addition to our general Terms of Use (the “Terms”) and Privacy Policy.  The Premium Terms govern your access to and use of any paid or subscription-based features ("Premium Services") provided by City Calibration Centers, Inc. (“we,” “us,” or “our”) thorough your access to and use of our products and services, including any content, functionality, and services offered on or through www.citycalibrationcenters.com ("Website") or related mobile applications or through our device known as the Portable Gas Detector LMP 200. 

By purchasing or using any Premium Services, you agree to these Premium Terms and to any additional terms presented to you at the time of purchase, including jurisdiction-specific provisions and platform-specific payment conditions. 

  1. SUPPORT TOOL ONLY 

THE SERVICES—INCLUDING THE WEBSITE, MOBILE APPLICATION, AND ASSOCIATED DEVICE—ARE DESIGNED TO ASSIST LICENSED PROFESSIONALS WITH THE DOCUMENTATION AND PROCESSING OF BUILDING INSPECTIONS, INCLUDING GAS DETECTION, AS REQUIRED BY APPLICABLE LAW. SPECIFICALLY, THE SERVICES MAY HELP USERS ORGANIZE INSPECTION OBSERVATIONS, COMPLETE DIGITAL VERSIONS OF GOVERNMENT-MANDATED FORMS, AND RETAIN INSPECTION-RELATED DATA IN A CENTRALIZED CLOUD ENVIRONMENT. 

The Services are intended solely as a support tool and do not constitute official governmental software or a substitute for compliance with applicable building codes, safety regulations, or inspection procedures. It is your sole responsibility to ensure that all forms, data, and observations generated through the Services meet the requirements of any regulatory authorities or agencies having jurisdiction over your inspections. 

Use of the Services does not confer regulatory approval or certification of any kind, and we do not guarantee that any reports or data produced will be accepted by any third-party agency, department, or inspector. 

  1.  Overview of Premium Services 

Some parts of our Services are available free of charge, while others require payment. These paid features—our Premium Services—may include: 

  • Storage of certain data; 
  • Priority access to new technology and upgrades; 
  • Enhanced features or tools not available to free-tier users; 

 

Premium Services may be offered on a subscription or one-time purchase basis, as indicated at the time of purchase. 

  1. Eligibility Requirements 
  • To use Premium Services, you must: 
  • Be a registered user; 
  • Be at least 18 years old, or the age of legal majority in your jurisdiction; and 
  • Be legally capable of entering into a binding agreement. 

We reserve the right to restrict or revoke access to Premium Services if you do not meet these requirements or violate our Terms. 

  1. Fees, Taxes, and Payment Terms 

You agree to pay all applicable fees for Premium Services, as disclosed at the time of purchase. Prices are listed in the applicable currency and may be exclusive or inclusive of taxes, depending on your jurisdiction (e.g., VAT-inclusive pricing in the UK and EEA). 

We may charge additional taxes or fees as required by law. 

Additional or localized payment terms may be presented at checkout and will form part of these Premium Terms. 

Payments may be processed via: 

  • Third-party payment processors (such as Stripe, Paddle, or regional alternatives); or 
  • Authorized platforms (such as the Apple App Store, Google Play, or other app marketplaces). 

You agree to comply with any third-party terms governing the processing of your payment. 

  1. Subscriptions and Auto-Renewal 

If you enroll in a subscription plan, your subscription will automatically renew at the end of each billing period, and your selected payment method will be charged the then-current rate unless you cancel in advance. 

You can manage or cancel your subscription: 

In your account settings (if purchased directly); 

Through the relevant app platform (e.g., Apple, Google) if purchased via a third-party. 

Cancellations take effect at the end of the current billing cycle. You will retain access to Premium Services until that time. 

  1. Credit System and Purchase Options 

Inspection Credits 

Certain Premium Services, including the ability to complete and store inspection reports linked to Building Identification Numbers (BINs), are accessible through a credit-based system. Each completed inspection requires the use of one (1) credit. 

You may purchase credits in one of the following ways: 

  1. One-Time Purchase: Users may purchase twenty (20) inspection credits for a one-time fee of $259.00. These credits are valid for one year from the date of purchase. 
  1. Subscription Plan: Users may subscribe to a monthly credit plan for $200.00 per month, which includes twenty (20) inspection credits per billing cycle. This subscription requires a 12-month minimum commitment. 
  1. Additional Credits for Subscribers: Users enrolled in the subscription plan may purchase additional credits during their subscription term at a discounted rate of $9.99 per credit. 

All fees are quoted in U.S. Dollars and do not include applicable taxes, which may be applied depending on your jurisdiction. 

Credit Expiration and Rollover 

All credits, whether purchased through a one-time plan or monthly subscription, expire three hundred sixty-five (365) days after the date of purchase. After this period, any unused credits will be forfeited and are non-refundable. 

For users on the monthly subscription plan, unused credits from each month will roll over and remain active until they expire at the end of the applicable 365-day period. However, rollover credits may only be used during an active subscription term. 

Upon termination or non-renewal of a subscription, any unused credits that have not yet expired will remain available through the end of their 365-day term but may be subject to access restrictions or loss of certain Premium features. 

  1. Subscription, Credit Purchase, and Billing Terms 

Fees, Credit System, and Billing. Access to certain features of the Services—including inspection data entry associated with Building Identification Numbers (BINs)—is subject to a credit-based system. Each inspection requires the use of one (1) credit. 

Credits may be purchased through the following options: 

  1. One-Time Purchase: Users may purchase a pack of twenty (20) credits for $259.00. These credits must be used within 365 days of the purchase date and will expire thereafter. 
  1. Monthly Subscription: Users may subscribe to a monthly credit plan at $200.00/month, which includes twenty (20) credits per month, billed annually. Credits from the monthly plan roll over and remain available throughout the 12-month subscription period. All credits expire 365 days after their purchase date. 
  1. Additional Monthly Credits: Active subscribers to the monthly plan may purchase additional credits at a discounted rate of $9.99 per credit. 
  1. All fees are quoted in U.S. Dollars and are exclusive of applicable taxes, which may be charged based on your billing information and jurisdiction. Credits are non-refundable and non-transferable unless required by applicable law. 
  1. Storage Tiers and Pricing 

We provide free cloud-based storage for your inspection data up to a limit of 999 megabytes (MB). Once your total data usage exceeds that amount, the following monthly storage fees will apply: 

  1. 1 GB and above: $4.99/month 
  1. 10 GB and above: $19.99/month 

You will be notified when you approach your storage limit and given the option to upgrade. Storage plans are billed monthly and may be subject to automatic renewal unless canceled. 

Failure to pay applicable storage fees may result in restricted access to stored data or deletion in accordance with our data retention policies. 

  1. Data Retention and Deletion Policy 

We retain user-submitted inspection data and records in our cloud storage systems for a period of seven (7) years from the date of submission or purchase. 

If you use the Services without purchasing credits, subscribing, or otherwise paying for inspection-related services, your data will be retained for two (2) years from the date of upload. After that period, your data may be permanently deleted without further notice. 

We encourage users to download or export any critical data prior to the expiration of these retention periods. We do not guarantee data recovery once it has been deleted under this policy. 

  1. Refunds and Cancellations 

You may cancel your subscription at any time via your account or through your store of purchase. Upon canceling your Premium subscription, you will not receive a refund, but you will continue to have access to your Premium account for the remainder of your current billing cycle. 

  1. Price and Feature Changes 

We reserve the right to change the pricing or features of Premium Services at any time.  

  1.  Non-Payment and Suspension 

If your payment fails or is declined, we may suspend or cancel access to Premium Services until payment is successfully processed. We are not responsible for any resulting loss of access, data, or service functionality.
